How the Common Law made Private International Law
There are many ways to make private international law: if we look across the world we may think of three as the Roman, the Scholastic, and the Legislative. The approach of the common law is entirely different. Apart from a single international principle, it used, and only ever needed, the basic tools of its domestic private law. There is no grand theory; there are no far-sighted principles. All it had, and all it ever needed, was everyday domestic law, from which private international law emerged, almost as though it were a by-product. Yet even common lawyers struggle to understand this. The aim of the lecture will be to explain the institutional distinctiveness, and the coherence, of the common law approach to private international law.
